Shared Hosting Service Level Agreement

Your account must be current without past due balances in order for this agreement to be effective.

This agreement is based upon a 24 hour 30 day period.

Next Best Host provices a 99.95% SLA or higher on http and https services. If the SLA drops below 99.95% then a credit or refund will be provided as follows.
95.0% - 99.5% 25%
94.9% - 50% 50%
49.9% - 0% Full Refund

Exclusions
Circumstances beyond the reasonable control of Next Best Host, including, without limitation, acts of any governmental body, war, insurrection, sabotage, terrorism, armed conflict, embargo, fire, flood, strike or other labor disturbance, interruption of or delay in transportation, unavailability of or interruption or delay in telecommunications or third party services, virus attacks or hackers, failure of third party software (including, without limitation, e-commerce software, payment gateways, statistics or free scripts) or inability to obtain raw materials, supplies, or power used in or equipment needed for provision of this SLA;
Domani resolution failure due to autorative DNS servers used are not Next Best Host DNS servers and the domain doesn't correctly resolve to an IP address on our network;
Scheduled maintenance, including upgrades; emergency maintenance;
FTP, POP, IMAP, SMTP or shell customer access issues;
Outages or SLA failures resulting from any act or omission by Customer or its agents, including, without limitation, custom scripting or coding (e.g., CGI, Perl, HTML, etc.); negligence, willful misconduct; exceeding allowable monthly Site Traffic allocation; or any use of the services in violation of the applicable Terms Conditions or acceptable use policy;
Email or Web Mail delivery and transmission;
Outages elsewhere on the Internet that hinder access to a hosted account;.

Credits

The credit must be requested within 14 calendar days of the incedent being reported. This request must be made by the customer and submitted to support@nextbesthost.com. The credit will be added to your account after review and will be applied on the next generated invoice. The is dependant of the billing cycle you have with Next best Host.. The total amount refunded will not exceed the total amount paid monthly. This as well is depndant upon the billing cycle you have with Next Best Host.
